11:00 AM The Song Remains the Same: OFCCP’s Continuing Focus on Applicant Adverse Impact

We’ve all heard about the OFCCP’s increased focus on pay equity, especially after President Obama signed the Ledbetter Fair Pay Act as the first new law of his administration. But, in practice, the OFCCP continues to spend most of its time – and obtains more than 95% of its monetary settlements – on applicant-to-hire adverse impact. And there’s a new twist – the Agency now is focusing intently on “reverse discrimination” and sub-minority adverse impact – catching many employers unaware during audits. In this session, we’ll discuss the OFCCP’s latest adverse impact enforcement strategies and what you can do to respond.

2:00 PM Vets and People with Disabilities – Best Practices
             Breakout session and roundtable

After the two telecons that OFCCP Director Patricia Shiu held on Tuesday, January 12 and Thursday, January 14 on the Rehab Act and on VEVRRA, it is clear that she is seeking best practices from the contractor community especially on hiring of disabled and veterans. Participants brought their processes for outreach and hiring of disabled and veterans to discuss with their peers who led a discussion in the afternoon (see below). Nita took the best of the best practices back to Director Shiu and offered them to her on behalf of the WON network.

  • Veterans Leadership Network-Merck
    • Nora Vele of Merck, presented to members on Merck’s outreach to veterans to help them align their military skills with skills necessary to positions within Merck. They have also sponsored projects with many veterans organizations to provide support for injured veterans and to inform them of the opportunities available at Merck.
  • Affirmative Action Program for Covered Veterans and Individuals with Disabilities-Wells Fargo  
    • Bari Evans and Barton Bowne of Wells Fargo discussed their pilot project of having management reach out to veterans within Wells Fargo and having a career discussion with them in an effort to improve the retention of veterans within the organization. The pilot project will be rolled out through Wells Fargo within the next year.

  • Philosophical differences among diversity practitioners – what are the pros and cons?
  • Workforce analytics – can AA metrics and methodology be aligned with Diversity metrics and scorecards?  Can these be tied together in the “back office” to avoid the legal/compliance cloud over diversity work?
