Recommended Actions to Ensure Compliance
In light of substantially increased compliance risk, employers should identify and review their most important HR processes to ensure compliance with antidiscrimination and other requirements. This includes an examination of selection (both hiring and promotion), performance management, compensation, termination including RIFs, and other relevant HR practices.OFCCP and EEOC have made it clear that they will be reviewing employment policies and practices to find barriers to the hiring and promotion of women and minorities. In addition, the DOL is making various changes in FLSA classifications that employers will need to make sure they are in compliance with. As a result, employers need to know the impact of their policies and practices before an audit or investigation begins.
